Summary:   The plaintiff alleged that the surgeon and primary care physician failed to diagnose breast cancer in a woman with breast implants.   The plaintiff was diagnosed with breast cancer and treated and was cancer free at time of trial.  The plaintiff is appealing the not guilty verdict.

Verdict: $61,000.00 Guilty (Settled for $57,000.00 before post-trial motions)

Summary:  Dental malpratice case involving allegations of ill fitting crowns and decay under the crowns that were so painful that it ruined plaintiff's wedding and resulted in extraction of teeth and required work done on teeth by subsequent dentist.

Summary: Plaintiff alleged lack of informed consent and negligent surgeries, both feet on great toe and tailor bunionectomies.  Plaintiff alleged constant pain, inability to work full-time and decreased enjoyment of life.

Summary: Death of a four year old boy in emergency room. Defense alleged child suffered from previously undetected fatal disease. Plaintiff claimed mismanagement in the emergency room.

 

Case Name:  Bangert v. Emergency Medicine Physician

Summary: Death of seven month old infant from intussusception. Insured at Hospital No. 1 transferred baby to Hospital No. 2 for diagnosis and treatment.

 

Case Name: Smith v. Trauma Surgeon

Venue: Cook County, Illinois

Demand: $2 million against all defendants.

Verdict: Insured paid $400,000.00 in settlement before opening statements. Co-defendant emergency physician also paid $400,000.00.

Summary: Death of a 48-year old man involved in a car accident and brought to emergency room with undiagnosed transected aorta. Insured trauma surgeon was called from emergency room, but did not come in to evaluate patient for several hours. By the time insured arrived, dramatic life-saving measures were necessary, (chest opened in emergency room), but plaintiff died.

Verdict: Jury deadlocked 9 to 2 with majority in favor of "not guilty" verdict. "High/low" settlement agreement reached to avoid mistrial and retrial.

Summary: Death of a 60-year old woman with husband and adult children with undiagnosed sarcoma in shoulder. Family practitioner did not order work up of shoulder pain for 18 months. When plaintiff went to another physician, cancer was diagnosed in advanced stage.

 

Case Name: Pratt v. Emergency Medicine Physician

Summary: Medical malpractice case involving death of a 28-year old woman with a three-year old child who was discharged from the emergency room with diagnosis of bronchitis. She died of acute myocardial infarction that evening.

Verdict: Settlement of $500,000.00 on behalf of insured after trial began.   $17 million verdict against remaining defendants.

Summary: "Locked in" quadriplegic 33-year old contractor who had stroke in operating room during back disc surgery. Insured cardiologist cleared him for surgery without treating symptoms of TIA (transient ischemic attack) and unmedicated hypertension.

 

Case Name: Chrysler v. Family Practice Physician

Venue: Cook County, Illinois

Summary: Medical malpractice case involving the wrongful death of a 55 year old husband and father of adult children who died of pulmonary embolism after being diagnosed and treated by oral anticoagulants and not I.V. heparin.
