A concerning aspect of the Act is that the profiles will include all settlements entered into by a physician in the last five years.  At the time of the settlement, the physician was unaware that such information would be made publicly available. All information contained on a physician’s profile regarding settlement will be accompanied by the following statement:

 

Settlement of a claim may occur for a variety of reasons which do not necessarily reflect negatively on the professional competence or conduct of the physician. A payment in settlement of a medical malpractice action or claim should not be construed as creating a presumption that medical malpractice has occurred.

 

Pending medical malpractice claims will not be disclosed by the IDFPR to the public. 

 

Additionally, a medical malpractice judgment or award that has been appealed will be identified as “Under Appeal” on the physician’s profile within twenty (20) days of formal written notice to the IDFPR.  If you have any questions or comments regarding this new Act, please contact Madeleine Weldon-Linne at mweldonlinne@wlv-online.com
